US Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Background of the Case
The court proceedings involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.
Terms of Freedom
The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complicated legal case involving claims of mistaken imprisonment and contested gang affiliations.
